In Canada on a court battle BMW has failed to prevent Nissan from using the letter 鈥楳鈥� for what BMW pictured as its rival鈥檚 鈥渋nferior and more modestly priced鈥� cars. Several months ago BMW originally won an injunction and stopped Nissan from using the letter.
The difficult part is proving that there was a trademark violation but BMW won鈥檛 stop from appealing. In Munich the officials didn鈥檛 object to Nissan using the letter for the Infiniti 鈥淢35鈥� and 鈥淢45鈥�. Only when the Japanese carmaker ran a publicity action in Canada, which stated 鈥渢he M is coming,鈥� they decided to stop.
The only option now for BMW is to reach an agreement with Nissan or petition to the Supreme Court.
